Terms & Conditions

§ 1 Scope

These Terms and Conditions (T&Cs) apply to all contracts between Christian Brettenthaler, Hauptstraße 37, 8074 Raaba-Grambach, Austria (hereinafter the "Provider"), operator of cbnode.at, and its customers regarding the use of the Ajax Bridge portal. Deviating terms and conditions of the customer are not recognized unless the Provider expressly agrees to their validity in writing.

§ 2 Description of Services

The Provider makes available a software-as-a-service solution ("Ajax Bridge") that connects alarm systems manufactured by Ajax Systems with the Provider's cloud platform and makes device states, events and control commands available via an MQTT interface as well as a REST API. The Provider strives to continuously develop the service further but assumes no obligation to provide specific features that have not been expressly agreed upon.

§ 3 Conclusion of Contract

The contract is concluded through the customer's registration in the Ajax Bridge portal and the subsequent activation of the account by the Provider. There is no legal entitlement to activation; the Provider may decline registrations without stating reasons.

§ 4 Prices

The following prices apply (per system and per year):

  • Private customers: € 49.00 incl. statutory VAT
  • Business customers: € 59.00 net

Billing takes place for one full year at a time from the date the system is activated. Payment is made by bank transfer.

§ 5 Term and Termination

Contracts are concluded as annual subscriptions and automatically renew for a further year each time unless terminated in the proper form and within the deadline as of the expiry date. Should the Provider intend to discontinue the service in whole or for individual systems, customers will be notified at least 30 days in advance.

§ 6 Availability

The Provider aims for a service availability of 99% on a yearly average but does not guarantee this. Availability depends, among other things, on third-party systems (in particular the Ajax Cloud) and on maintenance work.

§ 7 Data Protection

§ 8 Liability

The Provider is not liable for outages or disruptions of the Ajax Cloud or other third-party systems over which it has no control. Otherwise, the Provider's liability is limited, to the extent permitted by law, to the amount paid by the customer for the current contract year. This limitation does not apply in cases of intent, gross negligence, or personal injury.

§ 9 Jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. To the extent permitted by law, Graz is agreed as the place of jurisdiction.
